2. CONDITIONS OF ACCESS AND USE OF THE PORTAL
2.1. User Condition
Acceptance of the general conditions with the use of any Portal Service grants you the status of User thereof.
In general, User Registration is not required to access the Portal Services. However, the use of certain Services (which will be notified in advance on the website) may or may not be subject to prior User Registration. When this registration is mandatory, it will be carried out in the manner expressly indicated in the Service itself or in the applicable Specific Conditions.
2.2. Use of the Portal and its services
The User acknowledges and accepts that use of the content and/or services offered by the portal owner is at his or her sole risk and/or responsibility.
The User agrees to use the Portal and all of its content and Services in accordance with the law, morality, public order, and these General Terms of Use, and any applicable Specific Terms and Conditions. The User also agrees to make appropriate use of the Portal’s services and/or content and not to use them to engage in illegal activities or activities that constitute a crime, violate the rights of third parties, and/or infringe intellectual and industrial property regulations or any other applicable legal provisions.
The User agrees not to transmit, introduce, distribute, or make available to third parties any type of material or information (data contained, messages, drawings, sound and image files, photographs, software, etc.) that is contrary to the law, morality, public order, and these General Conditions of Use and, where applicable, the Specific Conditions that apply to them. By way of example, but in no way limited to or exclusive of these Terms and Conditions, the User agrees to:
1) Do not introduce or distribute content or propaganda of a racist, xenophobic, pornographic nature, in support of terrorism, or that violates human rights.
2) Do not introduce or distribute data programs (viruses and harmful software) on the network that could cause damage to the computer systems of the access provider, its suppliers or third-party users of the Internet.
3) Not to disseminate, transmit or make available to third parties any type of information, element or content that violates the fundamental rights and public freedoms recognized by the Constitution and international treaties.
4) Not to disseminate, transmit or make available to third parties any type of information, element or content that constitutes illicit or unfair advertising.
5) Do not transmit any unsolicited or unauthorized advertising, promotional materials, «junk mail,» «chain letters,» «pyramid schemes,» or any other form of solicitation, except in those areas (such as commercial spaces) that have been exclusively designed for such purpose.
6) Do not introduce or disseminate any false, ambiguous or inaccurate information or content in a manner that misleads the recipients of the information.
7) Not to disseminate, transmit or make available to third parties any type of information, element or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks or copyrights that belong to the owners of the Portal or to third parties.
8) Do not include on our pages content that indicates or promotes sexual, racial, or religious discrimination, or any other violation of fundamental rights and freedoms recognized by Spanish law; that induces or incites illegal behavior or leads to erroneous conclusions due to inaccuracy, omission, or similar; that contains false or outdated information; that violates legal or regulatory standards regarding the confidentiality of communications, intellectual property, the right to honor and personal privacy, or that incorporates violent or degrading content, messages, or products.
3. INTELLECTUAL AND INDUSTRIAL PROPERTY
The content, elements, and information that the user may access through https://hy2fish.arvi.org/ are subject to the industrial and intellectual property rights of the portal owner or third parties. Consequently, access to these contents or elements does not grant the user the right to alter, modify, exploit, reproduce, distribute, or publicly communicate them, nor any other right that may correspond to the owner of the affected rights.
The User must refrain from removing any identifying marks of intellectual, industrial, or other property rights belonging to www.arvi.org or third parties that appear on the Portal and in each of the various Services offered through it. Likewise, the User must refrain from circumventing or manipulating any technical devices established by the Portal owner or by third parties, whether on the Portal, in any of the Services, or in any of the materials, elements, or information obtained through it, for the protection of their rights.
4. EXCLUSION OF WARRANTIES. LIABILITY
4.1. Availability and Continuity of the Portal and Services
The owner of the portal does not guarantee the availability, access, and continuity of the operation of the Portal and its Services.
The owner of the Portal shall not be liable, within the limits established by current legislation, for any damages caused to the User as a result of the unavailability, access failures, or lack of continuity of the Portal and its Services.
4.2 Contents and Services
The owner of the portal shall be solely and exclusively responsible for the services it provides and for any content directly generated. This liability shall be excluded in cases of force majeure or in cases where the user’s equipment configuration is inadequate to allow proper use of the Internet services provided at https://hy2fish.arvi.org/.
4.3 Third Party Content and Services
The owner of the Portal does not pre-control, approve, or endorse the content, services, opinions, communications, data, files, products, or any type of information from third parties, whether legal or natural persons, contained on the Portal. Likewise, the owner does not guarantee the legality, reliability, usefulness, truthfulness, accuracy, completeness, or timeliness of the content, information, and services of third parties on the Portal.
The owner of the portal does not pre-control and does not guarantee the absence of viruses or other elements in the Content and services provided by third parties through the Portal that could cause alterations to the computer system, electronic documents, or files of users.
The owner of the Portal shall not be liable, either indirectly or indirectly, for damages of any kind arising from the use and contracting of third-party Content and Services on the Portal, as well as for their lack of legality, reliability, usefulness, truthfulness, accuracy, completeness, and timeliness. By way of example, and in no case limited to, the owner shall not be liable for damages of any kind arising from a) the infringement of intellectual and industrial property rights and the defective performance or breach of contractual commitments acquired by third parties; b) acts of unfair competition and illegal advertising; c) the inadequacy and disappointment of expectations regarding third-party Services and Content; d) defects of any kind in the third-party Services and Content provided through the Portal.
The owner of the portal shall not be liable, either indirectly or indirectly, for damages of any kind arising from the negligent or malicious use of email accounts used for any type of entry, communication, management, or action on the Portal.
The owner of the portal shall not be liable, either indirectly or indirectly, for any damages of any kind caused to the User as a result of the presence of viruses or other elements in the content and services provided by third parties that may cause alterations to the user’s computer system, electronic documents, or files.
4.4 User Conduct
The owner of the Portal does not guarantee that Portal Users will use the contents and/or services in compliance with the law, morality, public order, or these General Conditions and, where applicable, any applicable Specific Conditions. Likewise, it does not guarantee the truthfulness, accuracy, completeness, and/or authenticity of the data provided by Users.
The owner of the Portal shall not be liable, either indirectly or subsidiarily, for any damages of any kind arising from the use of the Portal’s Services and Content by Users or that may arise from the lack of veracity, accuracy, and/or authenticity of the data or information provided by Users, or from the impersonation of a third party by a User in any type of action through the Portal.
5. CONTRACTING WITH THIRD PARTIES THAT ADVERTISE ON THE PORTAL.
The User acknowledges and accepts that any contractual or extracontractual relationship that they may enter into with advertisers or third parties contacted through the Portal, as well as their participation in contests, promotions, sales, or rentals of goods or services, are understood to be solely and exclusively between the User and the advertiser and/or third party. Consequently, the User accepts that the owner of the portal https://hy2fish.arvi.org/ bears no liability for damages of any kind arising from their negotiations, conversations, and/or contractual or extracontractual relationships with advertisers or third parties, whether natural or legal, contacted through the Portal.
6. TECHNICAL DEVICES FOR TEXTUAL LINKAGE
The Portal provides users with technical linking devices and search tools that allow them to access web pages owned by other entities (textual links).
The user of the portal acknowledges and accepts that the use of the content of the linked web pages will be at his or her sole risk and responsibility and exonerates the owner of the portal from any liability regarding the technical availability of the linked web pages, the quality, reliability, accuracy and/or veracity of the services, information, elements and/or content that the client can access on them and in the search directories included in the Portal.
The owner of the portal shall not be indirectly or subsidiarily liable for damages of any kind arising from a) the operation, unavailability, inaccessibility, or lack of continuity of the linked web pages and/or available search directories; b) the failure to maintain and update the content and services contained on the linked web pages; c) the lack of quality, inaccuracy, illegality, or uselessness of the content and services of the linked web pages.
7. DURATION AND TERMINATION
The provision of the services and/or content of the Portal is for an indefinite period. Notwithstanding the foregoing, the owner of www.arvi.org is authorized to unilaterally terminate, suspend, or interrupt, at any time and without prior notice, the provision of the service and the Portal and/or any of its services, without prejudice to the provisions set forth in the corresponding specific conditions.
8. LAW AND JURISDICTION
All matters relating to the Portal are governed by Spanish law and subject to the jurisdiction of the Courts of Vigo.
